Please read all contest rules below carefully to ensure that you are qualified to submit an entry, and are willing and able to follow all rules.


Entry Period

* Photos must be shot between November 6th, 2017 thru and including February 28th, 2018

* Last day to submit is March 7, 2018

* Entries submitted after March 7, 2018 will not be eligible

* Event is 100% free to participate

* All submissions must be made online at Zak Noyle Changing of the Tides Contest Page

Voting Period

* Public voting period commences (TBD) and ends (TBD)

* Judges and Surfline voting commences (TBD) and ends (TBD)

Eligibility

* Good swimming skills and comfortable in surf

* Hawaii resident only   (Hawaii ID / proof of residency required when registering) {Why Hawaii only? I want to give back to where I grew up, helping young Hawaii photographers to have an opportunity to reach the world stage. An international contest will be planned for Summer of 2018.}

* Open to amateur photographers only

* You will be ineligible if you have previously had a Surfline or FreeSurf profile of any type

* You will be ineligible if you are on a monetary retainer with any surf brand

What To Enter

* Must submit a total of 10 images, minimum of 1 image per Category (below).

1) Water Action - Any wave-riding shot in the water
2) Land Action - Any wave action shot from land
3) Lifestyle - Capture the spirit of surf, in a non-posed image
4) Portrait - A portrait shot capturing a human, posed
5) Empty Wave - From land or from sea, capture the power and beauty of the ocean with no wave riders
6) New Creativity - Get creative, thinking outside the box with exposures, lights, angles or surfers. This is to show your creativity in a unique and different way

 

* Must be shot in the State of Hawaii, anywhere throughout Hawaii during the contest period

* You must own the undisputed copyright to all your photographs.

* Must shoot in RAW file format; RAW file must be available upon request

* Submit Edited JPEG for judging

* Digital files must be saved as hi-res JPEG in RGB format. Files should be named LastName_FirstName_CategoryName.jpg. Note - no accented or punctuation characters in the filename such as #2*^.

* Published material for which non-exclusive rights were granted may be entered as long as you still maintain the right to grant us a license (see "Your Rights" below). You must be able to disclose when and where the photo appeared previously upon request

* The following submissions are ineligible:

1. Photos that contain sexually explicit, nude, obscene, violent or other objectionable or inappropriate content
2. Images that involve the willful harassment of wildlife, or damage to the environment by the photographer

 

How To Enter

* Entrant information and images must be submitted through our photo submission web page, with all required fields including name, email and other information about your photo submission

* You may only enter the contest once, and may not enter using an alias name or another person’s name to submit your own photos

Sponsor

Zak Noyle Photography (“Sponsor”) is the official contest sponsor, Changing of the Tides Email. Additional prize sponsors participate through prize contributions. This contest is in no way sponsored by, endorsed by, or associated with Facebook or Instagram.

Winner Requirements

Except where prohibited, a potential winner may be required to complete and return an affidavit of eligibility, including proof of age, and liability/publicity release within 14 days. If a potential winner fails to return these documents on time, an alternate potential winner may be selected in his/her place.

All submitted images must be owned by winner and available for publicity.

Final prizes to be released shortly. Major prizes may include:

* All-expenses paid trip with Zak and a major sponsor to an upcoming surf location
* Major publicity in online surf media
* Branded t-shirts from T&C surf designs Hawaii retail chain

Judging Criteria

Qualifying entries will be judged on originality, technical excellence, composition, artistic merit, depth and variety within each category. At least one image must be submitted per category, with a total of 10 images submitted. We will be looking for the most well rounded and professional quality photographer with skills throughout each category. We will be looking for someone has future potential in all aspects to move forward into a promising career as a surf photographer.

* Judging will be a "blind" process; photographer's names will only be disclosed to judges after the judging process has been completed.

* All judging decisions are final. Please do not contact us about the status of entries or judging.

* Zak Noyle will notify the winner(s) via the contact information provided at the time of entry.

Award Ceremony

To be held in March 2018 at The Modern Honolulu, exact date and location TBD. A special email newsletter will be issued to announce the ceremony, so be sure to join Zak's email list.

Your Rights

Your photographs help promote the surf and surf photography industries. Thank you for helping to further our mission through your photography.

You will retain all rights to any photograph you submit -- including your (c) copyright ownership.

All appropriate use by Zak Noyle and Sponsors will include photographer's name and (c) credit.

No photograph will be sold to any third parties, and no digital / RAW files will be provided to any party outside of the contest judges.

If you submit a photograph to enter the Photo Contest, you agree to provide Zak Noyle non-exclusive world-wide rights to:

1. Display the photograph(s) on Zak's web site, Zak’s Instagram, and Zak's Facebook pages (other sites TBD), only after the contest Entry Period is closed, and judging commences.
2. Use winners' names, likeness and image in connection with the contest as Zak Noyle sees fit, for marketing and promotional purposes across all media, though there may not be any monetary compensation.
3. Allow Sponsors participating in the contest to share the photograph(s) on their social media.
4. Use the photograph on the Internet and in Social Media in support of the contest.
5. Provide your photograph to other media- and marketing-related individuals and organizations for promotion of the photographer and the contest in news stories, newsletters, reports, slide shows, displays, web pages, videos, and the like during judging and for up to 12 months after award.
6. Use, in connection with the Photo Contest, your name, city, state and country of residence in promotions and other publications.
 

General Conditions

In the event that the operation, security, or administration of the Photo Contest is impaired in any way, Sponsor may, in its sole discretion, either:

(a) suspend the Photo Contest to address the impairment and then resume the Photo Contest; or
(b) award the prize(s) from among the remaining eligible entries received up to the time of the impairment.

Sponsor reserves the right, in his sole discretion, to disqualify and seek damages from any individual who tampers with the operation of the Photo Contest, violates these Official Rules, or acts in a disruptive or unsportsmanlike manner.

Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

Proof of sending any communication to Sponsor by mail shall not be deemed proof of receipt of that communication by Sponsor.

In the event of a dispute as to the owner of an online entry, the authorized account holder of the e-mail address used to enter will be deemed to be the owner.

The Photo Contest is subject to federal, state, and local laws and regulations and is void where prohibited.

Release and Limitations of Liability

By entering, you agree to release and hold harmless Zak Noyle, Zak Noyle Photography, Prize Sponsors, Facebook, Instagram, their respective parent, subsidiaries, affiliates, and each of their respective officers, directors, employees, and agents (the “Released Parties”) from and against any claim or cause of action arising out of participation in the Photo Contest or receipt or use of any prize, including, but not limited to:

(a) unauthorized human intervention in the Photo Contest;
(b) technical errors;
(c) printing errors;
(d) late or undelivered mail;
(e) errors in the administration of the Photo Contest; or
(f) injury or damage to persons or property. You waive the right to claim any attorneys’ fees and any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.

* Image copyright remains the property of the photographer even though permission to use imagery is given to Changing of the Tides by Zak Noyle.

Privacy and Publicity

Any information you submit as part of the Photo Contest will be used in accordance with Sponsor’s Privacy Policy. The information you provide when you enter is provided to Sponsor, not to Facebook or Instagram. Except where prohibited, you consent to Sponsor’s use of your name in any list of winners (if applicable) and for promotional purposes in any media without further payment or consideration.

Disputes

You agree that any and all disputes, claims and causes of action arising out of, or connected with, the Photo Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Hawaii.

All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, your rights and obligations, or the rights and obligations of Sponsor in connection with the Photo Contest, shall be governed by, and construed in accordance with, the laws of the State of Hawaii, without giving effect to any choice of law or conflict of law rules (whether of Hawaii or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than Hawaii.
